WPC import licensing

An import license is a document issued by a national government authorizing the importation of certain goods into its territory. Import licenses are considered to be non-tariff barriers to trade when used as a way to discriminate against another country's goods in order to protect a domestic industry from foreign competition. Each license specifies the volume of imports allowed, and the total volume allowed should not exceed the quota. Licenses can be sold to importing companies at a competitive price, or simply a fee. However, it is argued that this allocation methods provides incentives for political lobbying and bribery. Government may put certain restrictions on what is imported as well as the amount of imported goods and services. For example, if a business wishes to import agricultural products such as vegetables, then the government may be concerned about the impact of such importations of the local market and thus impose a restriction. OR Import license is mandatory for shipment of any wireless equipment (whether licensed or de-licensed frequency band products). Below documents are required for obtaining the license:- Duly filled application Copy of Signed "Purchase Order" from the applicant to foreign supplier Technical literature/ specification of the equipment regarding the band of frequency, power etc should be furnished and match with decision letter. Extended Producer Responsibility (EPR)

means responsibility of any producer of electrical or electronic equipment, for channelization of e-waste to ensure environmentally sound management of such waste. Extended Producer Responsibility may comprise of implementing take back system or setting up of collection centres or both and having agreed arrangements with authorised dismantler or recycler either individually or collectively through a Producer Responsibility Organisation recognised by producer or producers.

As per the new E-Waste (Management) Rules 2016, it has become mandatory for bulk consumers, producers and manufacturers of all electrical and electronic equipment to bide by their EPR. These rules clearly indicate that a target is set for a bulk producer as per their market share to channelize their e-waste for responsible recycling.

Any product bearing the GS Mark indicates that it was tested and complies with the minimum requirements of the German Product Safety Act (a.k.a. ProdSG)

The GS Mark, which stands for “Geprüfte Sicherheit” in German and means Safety Tested, is a licensed mark of the German government and may only be issued by an accredited product safety testing and certification agency.


Toys Testing

The commerce ministry of India revised the policy conditions for toy imports on 1st September 2017 and said that with immediate effect the inbound shipment of toys is allowed freely when accompanied with certain types of safety certificates.

The India Directorate General of Foreign Trade (DGFT) in notification said that "Import of toys shall be permitted freely when accompanied" by certain certificates such as a certificate that the items being imported conform to the standards prescribed by Bureau of Indian Standards.

In addition, a certificate of conformance from the manufacturer that a representative sample of the toys being imported has been tested by an independent laboratory which is accredited by National Accreditation Board for Testing and Calibration Laboratories (NABL).

A certificate that the toys being imported into India must confirm conformance to the below specified Indian Toy Standards:

CE Marking

The Ce marking is required for many products. It:
  • shows that the manufacturer has checked that these products meet EU safety, health or environmental requirements
  • is an indicator of a product’s compliance with EU legislation
  • allows the free movement of products within the European market

By placing the CE marking on a product a manufacturer is declaring, on his sole responsibility, conformity with all of the legal requirements to achieve CE marking. The manufacturer is thus ensuring validity for that product to be sold throughout the EEA. This also applies to products made in third countries which are sold in the EEA and Turkey.
